To all persons to whom these presents Shall Come,
Greetings:
Know ye that I, Simon Perkins of Warren Trumbull County, Ohio, for the
consideration of good will and one dollar recd~ to my full Satisfaction of
Joseph Cole, Noah M. Green, & Lewis Humiston Directors of School District
No. Two in the township of Portage, Said District being known to contain
the South Town plat of Akron, do give and bargain Sell or confirm unto the
Said Directors the following described tract or lot of land situate in the
Township No. Two in the eleventh range of townships in the Connecticut
Western Reserve in the State of Ohio and which is also in the County of
Portage and is known by the whole of Lot Number thirty five end is bounded
as follows. vis. as Surveyed by Joshua Henshaw Esq. and as will appear of
record in the records of Deeds in Portage
County, And Whereas the Said Simon Perkins did a long time Since give a
writing to the citizens of
Akron one or more of them agreeing to give the land above
described for a cite for a School house for the benefit oŁ the
citizens
generally oŁ the South Town plat of Akron, and whereas Said
writing is not given up, nor is it known where it is but is supposed to be
forever lost. Now be it known that this Deed is given in compliance with
what is the supposed obligation of that instrument To wit, To Convey to
the Directors of the School District Containing and being the South town
Plat of Akron a Site for a school house for the Sole use of Said District
therefore be it further known that the said writing as well as all other
writings, contracts, covenants, promises, deeds, Mortgages having relation
to the premises contained in this deed of whatever name or nature (the
School Directors as named as well as other citizens now, consenting
thereto) is hereby revoked, recinded, annuled [sic] and made void,
having no binding force or effect whatsoever from the date of this
Instrument, It being expressly understood that this deed is given in
compliance with and in discharge of Said certain writing as before stated
the Said lot No. thirty-five; is on the South Town Plat of Akron & is
bounded as of record. To have and to hold the above granted and bargained
premises with the appurtenances thereunto belonging unto them
the Said Directors and to their successors in office forever, for the sole
use of Said District for the purposes aforesaid, And also I the Said Simon
Perkins do for myself, my heirs, executors and administrators covenant
with the Said Directors and their successors in office that at and until
the ensealing [sic] of these presents, I am well Seized of the
premises as a good indefeasible estate in fee simple and have a good right
to bargain and Sell the Same in manner and form as is above written, and
that the Same is free of all encumbrances whatsoever. And further more I
the Said Simon Perkins do by these presents bind myself and my heirs
forever to Warrant and Defend the above granted and bargained premises to
the Said Directors and their Successors in office against all lawful
claims and demands whatsoever. Excepting the Warranty of roads laid out,
and established by authority. And I Nancy Perkins do hereby remiss
release, and forever quit claim unto the Said Directors and their
Successors in office all my right and title of Dower in the above
described premises, In witness thereof, we have hereunto Set our hands and
seals this the 22 day of Nov. A. D. one thousand eight hundred and thirty
Seven. (November 22, 1837)
